What is the RERA escrow account framework?

Single-project account at RERA-approved bank under Law 8/2007. All buyer payments deposited; withdrawals only against verified milestones. Cornerstone of buyer protection. Verify escrow registration before signing.

What rights does the buyer have on project cancellation?

Decree 6/2010 — payments returned from escrow less developer's permitted retention based on completion stage. Where minimal works completed: full refund.

Can the buyer transfer/resell off-plan before handover?

Yes — addressed in SPA. Typically requires developer consent (cannot be unreasonably withheld); assignment fees capped under RERA Directions. Heavily negotiated for investor buyers.

What snagging and defects rights apply?

Snagging period 30-60 days from handover. Civil Code Article 880: 10-year decennial liability for major structural defects; 1-year warranty for installation defects. Common-area claims via JOPOA; unit-specific direct against developer/contractor.
