What counts as basic salary?

Basic salary is the contractual base figure stated in your employment contract — excluding housing allowance, transport allowance, telephone, food, education or any other benefits. UAE Labour Law uses basic salary as the sole input.

Resignation vs termination

Under the post-2022 framework (FDL 33/2021), the historical distinction between resignation and termination has largely disappeared — gratuity is paid in full in either case provided the qualifying service threshold is met. The exception is gross-misconduct termination under Article 44, which can forfeit the gratuity entitlement.

Free zones and DIFC/ADGM

Most UAE free zones apply the federal framework with zone-specific overlays. DIFC and ADGM operate separate employment regimes — DIFC under DIFC Employment Law, ADGM under ADGM Employment Regulations. End-of-service entitlement structures differ. This calculator covers onshore (federal) employees only.

Gratuity disputes are typically referred to the Ministry of Human Resources & Emiratisation (MOHRE) for mediation, then escalated to the Labour Courts.
